What is Wrongful Death?

Wrongful death claims are brought against a defendant (responsible party) who has caused someone’s death either through intentional harm or negligence. These civil action claims allow the estate of the deceased person to file a lawsuit against the party who is legally liable for the death.

As these lawsuits provide to seek compensation for the family members of the person or persons who have died as a result of negligent or reckless acts of others, willful or otherwise, an action must be brought by a surviving member. Who may legally initiate these suits can vary from state to state. In Arizona, a spouse, child, parent or guardian, or personal representative of the deceased person may file a claim. This can be done singularly or as a group. There are additional provisions designed to address disqualifications.  For more information, click here to read A.R.S. 12-612.

Common Causes of Wrongful Death

Work Accidents

Workplace fatality rates are higher than one might think. Some occupations can be more dangerous than others, but construction-related industries generally top the list, making up more than 20% of on-the-job deaths. OSHA has identified what is known as the “fatal four” when it comes to death on the job, most generally associated with construction-related occupations. They are:

  • Falls
  • Struck by Object
  • Electrocutions
  • Caught-in/between

Motor Vehicle Accidents

Motor vehicle accidents are a clear and obvious cause of wrongful death in America. This includes car, truck, motorcycle, boat, bicycle or pedestrian accidents, among others. We have all heard the statistics and it is proven to be one of the most prolific reasons for unexpected loss of life.

Medical Malpractice

Another leading cause of wrongful death, medical malpractice can come in several forms, such as:

  • Emergency Room or Hospital Errors
  • Surgical Errors or Medical Apparatuses Left Behind
  • Failure or Delay of Diagnosis
  • Prescription and Medication Errors
  • Defective or Dangerous Medical Devices
  • Birth Injuries
  • Low or Lacking Standard Of Care
  • Inattentive or Inexperienced Staff

Product Liability

Dangerous household products, defective autos or auto parts, and dangerous or defective medicines or medical devices are the most common elements in product-related death claims. The companies that manufacture products for consumers have a duty to ensure that their products are safe. When they fail to do so, the American public is exposed to the risk of injury or death. When a death occurs as the result of a defective product, survivors of the deceased can file a wrongful death lawsuit to recover damages.

Violent Criminal Act

No one expects something horrible to happen to a loved one, but when it does, surviving members of the victim can bring about a wrongful death action against the responsible party. This is separate from any criminal action that may be initiated by state or federal governmental departments, such as the Maricopa County District Attorney’s Office.
